Jaded Jewellery offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Service Terms,” “Terms”), including those additional terms and conditions and policies referenced herein and/or available via hyperlink. These Service Terms apply to all users of the site, including but not limited to browsers, suppliers, customers, vendors, and/or content contributors.

Please read these Service Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Service Terms. Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Service Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service, or any contact on the website through which the service is provided, without express written permission from us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

ARTICLE 1 - DEFINITIONS

For the purpose of these terms and conditions:

  • Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person not acting in the course of a business or profession who enters into a distance contract with the entrepreneur.

  • Day: 19-02-2025.

  • Continuous Transaction: A distance contract relating to a series of products and/or services, with the delivery and/or purchase obligation spread over time.

  • Durable Data Carrier: Any means that allows the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unaltered reproduction of the stored information.

  • Right of Withdrawal: The possibility for the consumer to cancel the distance contract within the cooling-off period.

  • Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.

  • Distance Contract: A contract concluded within the framework of a system organized by the entrepreneur for distance sales of products and/or services, whereby exclusive use is made of one or more remote communication techniques up to and including the conclusion of the contract.

  • Remote Communication Technique: A means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same location.

  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

ARTICLE 3 - APPLICABILITY

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge to the consumer upon request.

If the distance contract is concluded electronically, then, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be accessed electronically and that they will be sent to the consumer electronically or otherwise free of charge upon request.

If specific product or service terms apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly, and in the event of conflicting terms, the consumer can always rely on the most favorable applicable provision.

If any provision in these general terms and conditions at any time becomes wholly or partially void or is annulled, the agreement and these terms will remain in effect, and the relevant provision will be replaced by a provision that approximates the intent of the original as closely as possible.

Situations not covered in these general terms and conditions should be assessed “in the spirit” of these general terms and conditions.

Any uncertainties regarding the interpretation or content of one or more provisions of our terms should be interpreted “in the spirit” of these general terms and conditions.

ARTICLE 4 - THE OFFER

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a truthful representation of the offered products and/or services. Apparent mistakes or errors in the offer do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative and cannot give rise to compensation or dissolution of the contract.

Images of products are a truthful representation of the offered products. The entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products.

Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. This includes in particular:

  • The price, excluding customs clearance costs and import VAT. These additional costs are the customer’s responsibility. The postal and/or courier service will apply the special arrangement for postal and courier services regarding importation. This arrangement applies when goods are imported into the EU country of destination. The postal and/or courier service collects the VAT (whether or not together with the clearance costs charged) from the recipient of the goods;

  • Any shipping costs;

  • The method in which the contract will be concluded and the necessary steps for it;

  • Whether or not the right of withdrawal applies;

  • The method of payment, delivery, and execution of the agreement;

  • The period for acceptance of the offer, or the period within which the entrepreneur guarantees the price;

  • The rate for remote communication if applicable;

  • Whether the contract will be archived after its conclusion and, if so, how it can be consulted by the consumer;

  • The way in which the consumer can check and correct information before concluding the contract;

  • Any other languages in which the agreement may be concluded;

  • Applicable codes of conduct;

  • The minimum duration of the distance contract in the case of a continuing transaction.

ARTICLE 5 - THE AGREEMENT

The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and compliance with the associated conditions.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm the receipt of acceptance of the offer electronically. As long as the entrepreneur has not confirmed this acceptance, the consumer may dissolve the contract.

If the contract is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will observe appropriate security measures.

The entrepreneur may, within legal frameworks, ascertain whether the consumer can meet their payment obligations and consider relevant factors for responsibly concluding the distance contract.

ARTICLE 6 - RIGHT OF WITHDRAWAL

When purchasing products, the consumer has the option to dissolve the agreement without stating reasons within 30 days. This cooling-off period starts on the day after the consumer or a previously designated representative known to the entrepreneur receives the product.

During the cooling-off period, the consumer shall handle the product and packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep the product.

If the consumer wishes to use their right of withdrawal, they must notify the entrepreneur within 30 days after receiving the product through written communication/email. After notification, the consumer must return the product within 30 days.

ARTICLE 7 - COSTS IN CASE OF WITHDRAWAL

If the consumer exercises their right of withdrawal, the costs for returning the products shall be borne by the consumer.

If the consumer has made a payment, the entrepreneur shall refund this amount as soon as possible, but no later than 14 days after the withdrawal, subject to the applicable conditions.

ARTICLE 8 - EXCLUSION OF THE RIGHT OF WITHDRAWAL

The entrepreneur may exclude the consumer's right of withdrawal where legally permitted and clearly communicated before concluding the agreement.

This may include products:

  • Created according to the consumer's specifications;

  • Clearly personal in nature;

  • That cannot be returned due to their nature;

  • That can spoil or age quickly;

  • Whose price is tied to financial-market fluctuations outside the entrepreneur's control;

  • Certain sealed hygiene products once the seal has been broken.

ARTICLE 9 - THE PRICE

We reserve the right to change the prices of offered products and/or services where permitted.

Price increases within three months of concluding the agreement are only permitted if they result from legal regulations or provisions.

All prices are subject to printing and typographical errors. In the event of such an error, the entrepreneur is not obliged to deliver the product at the incorrect price.

ARTICLE 10 - CONFORMITY AND WARRANTY

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications listed in the offer, reasonable requirements of reliability and usability, and applicable legal provisions.

A warranty provided by the entrepreneur, manufacturer, or importer does not affect the legal rights and claims that the consumer may assert against the entrepreneur.

Any defects or incorrectly delivered products must be reported in writing to the entrepreneur.

The warranty does not apply if the consumer has improperly repaired, modified, or handled the product, or if the defect results from circumstances outside normal intended use.

ARTICLE 11 - DELIVERY AND EXECUTION

The entrepreneur shall exercise the utmost care when receiving and executing orders.

The place of delivery shall be the address that the consumer has provided to the company.

Accepted orders will be executed with due speed but no later than 30 days, unless the consumer has agreed to a longer delivery period.

If delivery is delayed or an order cannot be fulfilled, the consumer will be informed in accordance with applicable law.

The risk of damage and/or loss of products rests with the entrepreneur until delivery to the consumer or a previously designated representative, unless expressly agreed otherwise.

ARTICLE 12 - CONTINUOUS TRANSACTIONS: DURATION, TERMINATION, AND EXTENSION

Where applicable, consumers may terminate continuous agreements in accordance with the agreed termination rules and applicable consumer law.

Any renewal, extension, or termination terms shall comply with applicable legal requirements.

ARTICLE 13 - PAYMENT

Unless otherwise agreed, amounts owed by the consumer must be paid in accordance with the payment terms communicated during checkout.

The consumer is obliged to report inaccuracies in payment details without delay.

In the event of non-payment, the entrepreneur has the right, subject to legal limitations, to charge reasonable costs communicated to the consumer in advance.

ARTICLE 14 - COMPLAINTS PROCEDURE

Complaints about the performance of the agreement must be submitted to the entrepreneur fully and clearly described within a reasonable period after the consumer discovers the issue.

Complaints will be answered within 14 days from the date of receipt. If additional processing time is required, the consumer will receive an acknowledgement and an indication of when a detailed response can be expected.

If a complaint is found to be justified, the entrepreneur will provide an appropriate remedy in accordance with applicable law.

ARTICLE 15 - DISPUTES

Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are governed by applicable law, without limiting any mandatory consumer protections available to the consumer in their country of residence.

ARTICLE 16 - PERSONAL INFORMATION

The submission of your personal data through the store is subject to our Privacy Policy.

ARTICLE 17 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on our site or in the Service may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if information in the Service or on any related website is incorrect, subject to applicable law.

Due to measures regarding the Central Electronic System of Payment Information (CESOP), payment service providers may be required under applicable legislation to register and report certain payment information to the European CESOP system.
